We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been accurately described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given about the goods are approximate only.
We may make amendments to the material/content of this website at any time without prior notice. This includes the products and prices described on it.
Changes To Legal NoticesWe reserve the right to change these terms and conditions from time to time and you should look through them as often as possible. ONLINE SHOP REGISTRATION
In order to register your details with www.summerwinebrewery.com you must be over 18 years of age.
CONTRACT/ORDERING
Upon completing your order via our online checkout, you are deemed to have placed an order with us.
You are able to correct errors on your order up to the point by which you complete the online checkout during the ordering process on our online store.
Upon payment been received by us, we will confirm that your order has been received by sending an email confirmation to you at the email address that you specify when registering your order details with us.
An acceptance of your order will take place on despatch of the goods ordered. Our acceptance of your order brings into existence a legally binding contract between Summer Wine Brewery Ltd and you, the customer.
This will be the case unless we have notified you that we do not accept your order or you have cancelled your order.
We may refuse to accept an order and we reserve the right to cancel the contract between us if: i.) The goods ordered are not currently available. ii.) We do not deliver to your area or country. iii.) One or more of the goods that you ordered has a pricing or product description error. iv.) We cannot obtain authorisation for your payment. v.) You do not provide sufficient identification or information required when ordering certain products from our website. vi.) You do not meet the eligibility criteria that we have set out in our Terms & Conditions.
We will charge your credit/debit card account for payment upon receipt of your order. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.
If we do cancel your contract we will notify you by e-mail and will credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 28 days of your order.
All orders are subject to acceptance and product availability. If the product/products that you have ordered are not available from stock, we will contact you by e-mail or telephone. If the product will be returning to stock, you will have the option either to wait until the item is available again from stock or to cancel your order.
PRICING
All product prices are inclusive of VAT at the current rate and are correct at the time of entering information.
The prices payable for goods that you order are set out in our online store area of the website.
If it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email. We will offer to sell you the goods of the specification and description at the price stated in the email and will state the period for which the offer or the price remains valid.
DELIVERY POLICY
You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations.
Our delivery charges are set out in the online store part our website. These delivery charges vary according to geographical location. You, the customer must select the correct delivery charge that applies to your geographical location.
Please note that we are only able to deliver to addresses within the United Kingdom, but excluding the Isle of Wight, the Isle of Man, the Scottish Isles, parts of Scotland, Northern Ireland and the Channel Isles.
We will despatch your delivery via City Link couriers, who allow you to track the parcel to your door.
Our Standard UK delivery is next working day (excluding weekends and public holidays). However, some parts of Scotland including the Scottish Highlands, Next Working Day is not possible with Standard delivery taking approximately 2-3 working days.
We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed.
We cannot be held responsible for disruption to delivery of goods caused by industrial disputes, adverse weather or action outside our direct control. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative date. If such disruption occurs you may be offered delivery via an alternative delivery company or a full refund.
All orders received by us are shipped subject to availability and compliance with our Terms & Conditions.
We reserve the right to ship products at a later date (up to 28 days after purchase) if the product ordered is not in stock at the time of completing your purchase online. If fulfilment of your order cannot be completed within 28 days after purchase, you will be contacted and offered a full refund.
We will deliver the goods to the address that you specify for delivery in your order. It is important that this address is accurate. Please ensure there will be someone available to sign for the package when it arrives at your designated delivery address. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).
RISK & OWNERSHIP
You will become the owner of the goods that you have ordered when they have been delivered to you. Once the goods have been delivered to you they will be held at your own risk and responsibility and we will therefore not be liable for any losses or destruction.
Risk of damage to, or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full.
CANCELLATION AND RETUTNS POLICY
Under the Distance Selling Regulations you have the legal right to cancel your order within seven days of receipt of your goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. However, you will need to notify us if you wish to cancel your contract.
If you wish to cancel your order, notification must be submitted by email to orders@summerwinebrewery.co.uk. If the order has not already been shipped it will be cancelled. If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
Once you have notified us that you are cancelling your contract, any sum debited to us from your credit/debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition that they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we will be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
The goods must be returned to us within 14 days of receipt for a full refund or exchange. The cost of returning the items will be borne by you.
You will be re-credited for the costs incurred in returning faulty or unsatisfactory goods.
Your right to return the goods will not apply under the following circumstances: i) The product/products have been used ii) Any products that have been specifically customised for you
LIABILITY
If you do not receive the goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:
i.) to make good any shortage or non-delivery ii.) to replace or repair any goods that are damaged or defective; or iii.) to refund to you the amount paid by you for the goods in question in whatever way we choose
You must observe and comply with all applicable legislation and regulations which includes obtaining all necessary customs, import or other permits to purchase goods from our website. The importation or exportation of certain of our products to you may be prohibited by specific national laws. We make no representation and accept no liability in respect of the export or import of the goods that you order.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract. OWNERSHIP OF RIGHTS
